These terms apply to your use of Oddside, the online game, the app for Mac and Windows, the test server and this website. By downloading the game, signing in with your account or creating a character, you state that you have read and accept these terms. If you do not agree, do not use the game.
The processing of personal data is described in the Privacy Policy, which is part of these terms.
1. Who we are
Oddside is developed and operated independently, in Brazil (“we”). For anything in these terms, write to hello@playoddside.com.
2. The game is in pre-alpha
Oddside is in development and offered as a pre-alpha test. Therefore:
- the game may have errors, crash, change without notice or go offline, including for maintenance and updates;
- features, rules, numbers and content change between tests, and features described on the website or in documentation may not exist yet;
- characters, items and progress may be erased or reset at any time, with or without notice, and you have no right to recover them or to compensation for it;
- access to the test may be limited, and the test may be ended, paused or opened to more people in waves.
During the pre-alpha the game is offered free of charge. There are no in-game purchases. If that changes, these terms will be updated first and you will be told.
3. Account and age
To play you sign in with a Discord account. We receive your Discord identifier and name to create and recognize your game account, and nothing more. An account can have up to five characters.
The account is personal. You are responsible for what happens on it and must keep access to your Discord account secure. Do not sell, lend or transfer your account.
You must be at least 13 years old. If you are under 18, you need a legal guardian's permission to play and for us to process your data, and the guardian should read these terms and the Privacy Policy.
We may ask for information to confirm who controls an account, and refuse or end accounts that violate these terms.
4. License to use the app
We give you a personal, free, non-exclusive, non-transferable and revocable license to download, install and use the Oddside app to play. Unless the law allows it, you may not:
- copy, sell, rent or redistribute the app, or offer alternative servers that imitate it;
- decompile, reverse engineer or extract the game's code, data or files for commercial purposes;
- remove proprietary or copyright notices.
5. Conduct
Play fair and respect other people. You may not:
- use cheating software, automation (bots), macros that play for you in a way the game does not provide, or any other means to gain an advantage outside the rules;
- exploit game bugs for your own benefit, or fail to report serious ones, such as item or coin duplication;
- harass, threaten, discriminate against or stalk other people, or use names and messages that are hateful, sexually explicit, unlawful or that impersonate someone;
- attack, overload or try to break into the servers, other people's accounts or this website;
- sell or buy accounts, characters, items or in-game currency for real money or for other goods outside the game;
- publish other people's personal data without permission.
6. PvP, loot and defeat are part of the game
Oddside is a game of knowing risk. In marked areas, other players can attack your character and take what it wears and carries (full loot, except marked starter items). This is a rule of the game, not harassment or a violation of these terms, and gives no right to a refund or compensation. Inside the towns there are guards and law zones, and new characters may have temporary protection.
Nobody dies in the game: a defeated character is downed and then returns at the shrine. Deliberately pursuing a person outside the game, or using PvP to harass them, is still forbidden.
7. Items, currency and characters have no real-world value
Characters, items, currency, skills, houses and everything that exists in the game are part of the service, not property you own. They have no monetary value, cannot be exchanged for money and may be changed, removed or reset. You only receive the right to use them while you play, under these terms.
8. What you write
Character names, chat messages and other content you create in the game are your responsibility. You allow us, free of charge and non-exclusively, to store, display and transmit that content to other players and to us, only to run the game, and to record it for moderation and security. We may refuse, change or delete names and content that violate these terms.
9. Moderation and sanctions
To keep the game safe and fair, we may warn, mute, kick, suspend or ban accounts and delete content that violates these terms, according to the seriousness and repetition. Whenever possible we will say why. If you think we got it wrong, write to hello@playoddside.com and we will review the case.
You can also tell us about conduct or bugs you find.
10. Intellectual property
Oddside, its name, wordmark, texts, images, models, sounds, code and content belong to us or to those who licensed them to us, and are protected by applicable law. These terms transfer no right to you beyond the license in section 4.
Oddside is an independent project. Any third-party marks mentioned belong to their respective owners, and there is no connection to or endorsement from them.
Screenshots and videos of the game may be shared, including in streams and video channels, as long as it is for no unlawful purpose and it is clear the game is in development. If you send us suggestions or bug reports, we may use them without any payment.
11. Third-party services
To sign in to the game you use a Discord account, which follows Discord's own terms and privacy policy.
12. No warranty and limit of liability
The game is offered “as is”, in a test phase and free of charge. We do not guarantee continuous availability, freedom from errors or fitness for a particular purpose. To the extent the law allows, we are not liable for indirect losses, loss of progress, items or game data, or for interruptions.
Nothing in these terms limits rights that the law grants and that cannot be waived, including those under Brazil's Consumer Defense Code where it applies, nor liability for intent or gross negligence.
13. Ending and deletion
You can stop playing whenever you like. You can delete a character from the game's character list by typing its name: it is erased for good, along with what it carries and keeps in the bank. To delete your account and the data tied to it, write to hello@playoddside.com.
We may suspend or end access, or the game itself, at any time, in particular at the end of a test. In that case we will delete or anonymize data as described in the Privacy Policy.
14. Changes to these terms
We may update these terms, for example when a new test phase starts. The update date is at the top of this page, and relevant changes will be announced in the game or through another channel. Continuing to play after the notice means accepting the new version.
15. Governing law and contact
These terms follow Brazilian law. If you are a consumer, you may bring claims in the courts of your place of residence. Questions, requests and complaints: hello@playoddside.com.
